Terms & Conditions

These terms govern your use of ngoseattle.com and any pickup, delivery, or catering service you request from Ngõ in the Seattle, Washington area. By creating an account, submitting an order, or sending a catering inquiry, you agree to these terms and our Privacy Policy.

Who may order

You must be able to enter into a binding contract. If you are under the age of majority where you live, a parent or legal guardian must place the order for you.

Online checkout requires a customer account. You agree to provide current, accurate contact information, keep your password confidential, and promptly update your profile if your email, phone number, or delivery ZIP code changes. Owner accounts cannot place customer orders.

Menu, availability & order acceptance

Our menu, prices, portions, options, and availability may change. Some dishes are marked pickup-only because they do not travel well and cannot be included in a delivery order. Menu photography is illustrative; handmade food may vary in appearance.

We release a limited number of pickup and delivery slots. Adding an item to your cart or starting checkout does not reserve food or a time slot. A slot is reserved during the payment attempt, and an order is accepted when payment succeeds and we issue an order confirmation. If an item, slot, or order cannot be fulfilled after payment, we will contact you and provide an appropriate replacement, credit, or refund with your agreement.

Prices, tax & payment

All amounts are in U.S. dollars. Before you pay, checkout shows the item subtotal, promotional discount (if any), Washington sales tax, delivery fee (for delivery orders), and final total. You authorize Square to charge the payment method you submit for that final total.

Card details are collected directly by Square; Ngõ does not receive or store your full card number. We retain limited payment records such as the Square reference, payment status, receipt link, card brand, and last four digits for receipts, support, reconciliation, and refunds.

Promo codes are subject to their displayed eligibility, dates, minimum spend, usage limits, and discount cap. They have no cash value, cannot be combined unless we say otherwise, and may be rejected or withdrawn if expired, misused, or obtained improperly.

Pickup & delivery

You must select an open fulfillment date and window before the posted cutoff. Capacity and cutoff times shown at checkout are controlling. Please review the operational details in our Order, Pickup & Delivery Policies, which are incorporated into these terms.

For delivery, you are responsible for entering a complete address in the selected service zone and for being reachable at the phone number supplied. Estimated arrival windows are not guaranteed; traffic, weather, access issues, and the day's route may affect timing. We may contact you if the address cannot be located or safely accessed.

Changes, cancellations & refunds

The website does not provide self-service cancellation. Contact us as soon as possible if you need to change or cancel an order. Requests are not effective until we confirm them, and we cannot guarantee changes after preparation or route planning has begun.

Pickup changes made with less than two hours' notice are subject to the late-change terms in our Order Policies. If we cancel a paid order because we cannot fulfill it, we will refund the affected amount to the original payment method. Bank and card-network processing times are outside our control.

If something is missing, incorrect, damaged, or otherwise materially wrong, contact us promptly with your order details so we can review the issue. Any remedy will be based on the circumstances and does not affect rights that cannot be waived under applicable law.

Food allergies & dietary requests

Our kitchen handles common allergens, and ingredients or shared equipment may create cross-contact. Notes entered at checkout help us understand a request but do not create a guarantee that a dish is allergen-free. If you have a severe allergy, contact us before ordering so you can decide whether our preparation environment is suitable for you.

Catering inquiries

Sending the catering form is a request for information, not a confirmed booking. A catering engagement becomes binding only when scope, date, price, payment schedule, cancellation terms, and any other event-specific details are agreed to separately in writing.

Website use

You may use the site only for lawful, personal transactions with Ngõ. You may not place fraudulent orders; interfere with checkout or security; probe for vulnerabilities; use automated tools to scrape the site; harvest customer or business data; impersonate another person; or use the site in a way that harms us, our providers, or other customers. We may restrict access, void a promo, or cancel and refund an affected order when reasonably necessary to address fraud, abuse, or a security risk.

Our content

The Ngõ name, branding, photographs, menu copy, graphics, and site design are owned by us or used with permission. These terms give you no right to reproduce, publish, sell, or commercially use that content without prior written permission.

Third-party services

The site relies on third parties for payment processing, email delivery, hosting, database infrastructure, address suggestions, and Washington address/tax verification. Their services may occasionally be unavailable and their own terms and privacy policies apply when they process information. See our Privacy Policy for details.

Disclaimers & limits

We work to keep menu, schedule, pricing, and order information accurate, but the website may occasionally contain an error or experience an interruption. To the fullest extent permitted by law, the site is provided “as is” and “as available,” without implied warranties beyond those that cannot legally be excluded.

To the fullest extent permitted by law, Ngõ is not responsible for indirect, incidental, special, or consequential loss arising from use of the website. Nothing in these terms excludes liability or a consumer remedy that Washington law does not allow us to exclude.

Washington law & changes

These terms are governed by Washington law, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in a court with jurisdiction in King County, Washington, unless applicable consumer law requires otherwise.

We may update these terms as our services change. The date above identifies the version in effect. Changes apply prospectively when posted; the terms shown when you placed an order continue to govern that transaction.

Electronic communications

When you create an account or place an order, we send transactional emails—email verification, password resets, order confirmations, status updates, and cancellation or refund notices—that are necessary to operate your account and orders.

Promotional emails and announcements—such as promo codes, new pop-up dates, or delivery opening in your area—are optional. You may turn them on or off in Member Settings or use the unsubscribe link in any such email. Opting out of these does not stop the transactional messages above. See our Privacy Policy for details.
